Clause 1 Guidance of search on our homepage

 1. This agreement section provides usage guide for the search of our homepage offered by Tokyo Metropolitan Small and Medium Enterprise Support Center.

 2. The usage of this search function is based upon your prior consent to this agreement.

 3. On this agreement, the Tokyo Metropolitan Small and Medium Enterprise Support Center is referred to as TMSMESC.

Clause 2 Purpose of offering our homepage

The purpose of offering our homepage is to provide fundamental trade information and to support direct transactions among exporters, importers, manufactures and/or distributors.

Clause 3 Renewal of registered information

 1. TMSMESC requests firms and trade associations to update their corporate information by E-mail, FAX, etc. periodically.

 2. TMSMESC provides the homepage which contains the fundemental trade information from the above-mentioned firms and trade associations.

 3. TMSMESC does not take responbility for the contents of registered information.

Clause 4 Searching

 1. The searcher is allowed to use our homepage in line with the purpose of TMSMESC homepage under this agreement and related governing laws.

 2. The contents of registered information can be used by downloading and printing it.

 3. The searcher is allowed to use our homepage provided that he/she made the prior consent of all the matters described here in this agreement.

 4. The searcher is allowed to make the duplicates, copies, sales, publication or change of any parts of the contents of this homepage only when she/he agrees to all the clauses of this agreement and when she/he obtained the prior written consent of them from TMSMESC.

Clause 6 Language used in our homepage and application

 1. The information is provided in two languages, Japanese and English.

 2. Some information is offered only in Japanese or English.

 3. The change from a Japanese screen to an English screen or vice versa can be made from the top page (except for some parts).

Clause 8 Intellectual property right of homepage

All the contents of registered information on this homepage are the properties (all rights, such as trademark rights and copyrights ) of TMSMESC or the registrants, and are protected by the law of intellectual property rights.

Clouse 9 Discontinuation & abolishment of search service

 1.TMSMESC shall take no legal and/or economic responsibility, even if discontinuation or disappearance

of service arise by the following.

  a. Due to the Internet and network environment.

  b. Due to the computer or a server problem.

  c. Due to the maintenance of the data system.

  d. Due to Fire, blackout

  e. Due to earthquake, eruption, flood ,tsunami (tidal wave) and/or any other natural disasters.

  f.  Due to war, riot, conflict, labor dispute, etc

  g. Due to the occurrence of situation where offering service becomes impossible due to force majeure.

 2. TMSMESC shall stop or abolish the service after notice.

Clause 10 Change of a part of agreement and/or the contents of services

TMSMESC shall have the right to change a part of this agreement or service contents without notice. When the notice is given, it will be posted on this homepage.

Clause 11 The responsibility of the searcher

 1. The searcher shall notify TMSMESC promptly, when finding the registered information is not adequate to be shown, as follows:

  a. Any part of the information contained seems to make someone uncomfortable and to bring disgrace.

  b. Any part of the information contained seems to be offensive to public order and standards of decency.

 2. Regarding the handling of above-mentioned contents of notice, TMSMESC shall have the discretion and shall take no responsibility, including explanation of treatment.

 3. The searcher shall use this homepage according to this agreement and all the relevant laws and regulations.

 4. The searcher shall not ask for any compensation for the damages caused and TMSMESC shall hold no responsibility for any damages caused related to this homepage, nor obligation for reparations and/or any legal expenses arisen by use of this homepage.

 5. The searcher shall not ask TMSMESC to be engaged in the lawsuit of a claim for damages made by the third party based on this service.

 6. The searcher shall take responsibility for the reparation to TMSMESC when she/he use our homepage for the purpose against any clauses of Searching without obtaining prior written consent of TMSMESC.

 7. The searcher shall compensate all the expense that contains reparations and lawyer expenses to TMSMESC, when damage is done to TMSMESC by the violation of this agreement, and the inaccurate or illegal act.

Clause 12 Charge for the use of search

 1. It is free of charge.

 2. TMSMESC may change the policy and may start charging in the future upon prior notice.

Clause 13 Governing law and Jurisdictional Court

 1. The governing law for this service is Japanese Law.

 2. In the event that the lawsuit arises for this service, the court which has the jurisdiction of TMSMESC shall become the exclusive jurisdictional court.
